Regulatory Body

Peru’s official gambling regulatory body is the General Directorate of Casino Games and Slots (La Dirección General de Juegos de Casino y Máquinas Tragamonedas), which operates under the Ministry of Foreign Trade and Tourism.

The enactment of Law No. 27,153 governing the operation of casino games and slot machines, along with its subsequent amendments, has established a comprehensive and consistent regulatory framework.

The authority is tasked with regulating, supervising, and controlling the gambling sector in Peru. All domestic operators must record every gambling transaction, pay taxes, and undergo an annual review. There is currently no fixed quota for licenses issued each year. Moreover, Peru’s legislation does not restrict foreign operators, allowing them to serve the market. This openness, however, can be a double-edged sword, as players might register with unlicensed operators.

Gambling Taxation

With the enactment of Law No. 31,557 in August 2022, all online gaming and sports betting entities in Peru are required to pay a 12% flat tax on their income. The levy applies to the difference between operators’ net monthly income and the maintenance costs of their platforms.

Regulations are expected to be released within 120 business days after the law’s publication. According to estimates, the taxes will generate $40 million in revenue for the Treasury. The proceeds will also be shared with the Ministry of Health, the Peruvian Sports Institute, and the Ministry of Foreign Trade and Tourism.

Under the same law, operators must register in the Single Taxpayer Registry, appoint a local legal representative, and use the “.pe” web domain for their platform. Operators that fail to meet these requirements will be ineligible for sponsorship and advertising deals.

A Selective Consumption Tax (ISC) will also be introduced, adding a 1% tax for gamers. Offshore companies, however, are exempt from this tax, and there is currently no obligation for them to establish a branch in the country. Although online gaming in Peru is thriving, it is still developing, and additional bills have yet to be enacted.
