Online Casinos

The number of online casinos with a Hungarian license is quite limited for a simple reason: only brick-and-mortar casinos are allowed to apply for online casino licenses. Offshore brands are not explicitly barred from doing so, but the application process is extremely cumbersome and slow. A local casino may form a joint venture with a foreign operator, but according to the Gambling Act the total number of land-based establishments is capped at 11, so Hungarian players should not expect much variety.

Still, the outlook is better than it might seem. Our research shows that plenty of international online gambling platforms accept players from Hungary. In practice, this gives locals access to an almost limitless selection of online games and enticing casino bonuses. The main downsides are that these sites rarely offer a Hungarian-language interface and do not always support transactions in the local currency.

New Online Gambling Regulation

After a prolonged period of inaction, the Hungarian Parliament passed an amendment to the gambling act in 2022, reshaping the regulatory framework for remote gambling. One aim of the amended Act is to prevent unlicensed remote gambling operators from serving players in Hungary. The competent authorities can now order data related to illegal gambling published over electronic communications networks to be made temporarily inaccessible.

The changes follow a CJEU ruling that Hungary’s legislation unlawfully excluded operators licensed in the EU/EEA from the licensing process. The revised Gambling Act introduces a multi-licensing model. Once they obtain approval from the Supervisory Authority of Regulatory Affairs (SARA), EEA-based companies will be allowed to offer online sports betting services to Hungarian users. Remote gambling, however, is permitted only through a branch that is both based and registered in the country.

Unfortunately, the provision of online casino games remains limited to holders of national land-based casino authorizations. Although the CJEU found this approach incompatible with EU law because it restricts the freedom to provide services within the Union, the regime in this sector is unchanged.

The draft laws are expected to take effect on January 1, 2023.

It is still unclear how the new rules will impact gambling taxation, but for now there is no tax on gambling winnings. Lottery remains the sole exception, with 16%-24% withheld from total winnings. At least until the new regulations come into force, casino operators are taxed as follows:

• Annual net gambling revenue below HUF 10 billion – 30%
• Annual net gambling revenue above HUF 10 billion – HUF 3 billion + 10% of the revenue above 10 billion
