Licensing and Legislation

To operate in Romania, land-based and online operators that provide games of chance, sports betting, or other forms of gambling must obtain a Class 1 license. In addition to the license, operators must also secure authorization for each gambling product they offer.

To qualify for a license, an operator must be based in the European Union, the EEA, or the Swiss Confederation. International online gambling sites must host servers in Romania so they can be monitored by the National Gambling Office, and their products and IT systems must be certified by a laboratory that holds a Class 2 license.

Class 1 licenses are valid for 10 years, provided the operator pays all fees associated with running a gambling business in Romania. Authorization, however, must be renewed annually.

Only casinos and sportsbooks that hold both a valid Romanian license and the required authorization may legally serve Romanian players. Unlicensed websites are forbidden to accept Romanian customers. Furthermore, unlicensed casinos are placed on an official blacklist, and Romanian ISPs are obliged to block access to them.

Taxes

Taxation for land-based establishments depends on the products they offer, whereas online operators are taxed based on their turnover. At the time of writing, online casinos must pay a €6,000 licensing fee each year if their annual turnover is below €500,000. Additionally, casinos with total income exceeding €10,000,000 in a 12-month period are subject to a €120,000 yearly tax. The annual authorization fee equals 16% of a remote operator’s GGR.

Romanian players are also required to pay tax on their gambling winnings. Withdrawals under €2,000 are taxed at 1%. Winnings up to €13,600 incur a 16% tax, while amounts above that threshold are taxed at 25%.

However, in August 2022, the Romanian government approved a bill that will raise gambling-related taxes. Beginning January 1, 2023, the annual Class 1 licensing fee for online gambling businesses will range from €15,600 to €312,000. The authorization tax will increase from 16% to 23% of the operator’s annual GGR. Player taxation will also change: winnings of up to €2,000 and €13,600 will be taxed at 6% and 20%, respectively, while withdrawals over €13,600 will be taxed at 40%.
